The Former President's System of Consequences and Incentives

Trump's insatiable urge for payback has quickly transformed into a structured framework. During the past year, the president's fury and whims have assumed the guise of administrative measures similar to reminiscent to earlier dictatorial governments. Government figures who resist his demands are immediately removed and substituted by devotees. Opposing figures who challenge him face indictment, trial and penalties. Critics have been designated under presidential directives as “anti-American”, “against faith communities” and “opposing economic freedom”, and warned with legal action as “security threats”.

The Justice System Remade

Each situation involving legal action of Trump's enemies and immunity for his allies demonstrates its own unique qualities. However, despite their particular character, they exemplify expressions of what has arisen as a deliberate technique. These episodes are far from random. Trump's cleansing of Department of Justice lawyers and Federal Bureau of Investigation personnel, alongside his appointment of devotees in key roles, started quickly, promptly took on a regularity, and has now been formed into a structure. DoJ and the Federal Bureau have been remade into partisan organizations under the president's clear direction to implement his directives. Injustice has been turned into routine. It constitutes the system of punishment.

Leadership is preoccupied with penalizing the chief's supposed enemies than they are with safeguarding our national security.

Inside the Apparatus

The foundation of this mechanism has been revealed in the legal complaint of multiple ex- top law enforcement executives lodged in September in the judicial system in the capital against agency head Kash Patel and top lawyer a key figure for unlawful firing in “a effort of retribution against them for what Defendants considered to be a refusal to show proper devotion”. In the complaint that Brian Driscoll, the ex- temporary head, details a conversation in which Patel “publicly confessed the unlawfulness of his conduct”.

He had tried to protect law enforcement officers from being terminated, the complaint alleges. The director informed him that “White House figures” – perceived by him to be the executive branch and DoJ – had instructed him to fire everyone who they considered as having been involved in a legal probe against him. The filing goes on: “Patel clarified that he had to dismiss the personnel his bosses told him to dismiss, because his ability to retain his own position depended on the removal of the officials who worked on investigations involving the President. The director explained that there was nothing he or the official could do to halt these or any other firings, because ‘the agency attempted to place the President in jail and he recalls it clearly.’” Once the official advised the director he was breaking the bureau's own regulations, he allegedly said “he recognized that and he realized the nature of the swift terminations were almost certainly illegal”.

Broad Effects

After his alleged admission to the official, the Department of Justice and the Federal Bureau have been gutted and reorganized for the administration's revenge apparatus. Six of the FBI's high-ranking agents were terminated or pushed out in the early weeks of the government. About numerous legal professionals at the department have accepted a “deferred resignation program”. No fewer than seven federal prosecutors, among them those in the Manhattan division, stepped down in dissent over what they regarded as partisan influence in withdrawing the legal action against the local official, the mayor, in exchange for his cooperation with Trump's ICE detentions of foreign nationals. The public integrity section of DoJ, which oversees misconduct investigations, has been diminished to minimal staff. The rights protection unit has been severely reduced: 70% of its employees has resigned. 33% of top officials at the department have resigned. The division implementing ecological regulations has experienced the exit of half its management.

Incentives and Penalties

Concerning the mayor's situation, the temporary lawyer for the federal division, Danielle Sassoon, resigned in protest against what she characterized as the “quid pro quo”. A key figure, his “enforcement chief,” was present as the enforcer with the mayor on a media outlet to state: “If he doesn't come through, I'll reappear in NYC.”. And, another figure, previously the justice department figure and a past legal representative, who brokered the agreement, was given an appellate federal judgeship, a potential pathway to the judicial branch.

His protection for crimes committed while in office, provided by the extraordinary ruling of the Republican majority on the highest court, thus blocking his prosecution over the January 6 insurrection and maintaining his electoral prospects for the national vote, is the foundation stone on which he stands to shield his supporters. Under these circumstances, he has been liberated to permit wrongdoing. The impact of the judicial ruling saturates his administration and the political party thoroughly. Trump v United States has spread. In the words of Richard Nixon's administration lawyer the figure remarked about the Watergate
